Terms and Conditions

This Terms and Conditions (hereinafter referred to as "the Policy") defines the terms of use for the online shop (hereinafter referred to as "the Service") provided on this website by GOC Co., Ltd. (hereinafter referred to as "the Company"). All registered users (hereinafter referred to as "Users") are required to use the Service in accordance with the Policy
Article 1 (Application)
  1. The Policy applies to all aspects of the relationship between Users and the Company regarding the use of the Service.
  2. The Company may establish rules and other provisions regarding the use of the Service (hereinafter referred to as "the Particular Provisions") in addition to the Policy. The Particular Provisions, irrespective of their designation, shall form part of the Policy.
  3. In the event that any provision of the Policy conflicts with the Particular Provisions referred to in the previous section, the Particular Provisions shall take precedence, unless otherwise specifically stated in the Particular Provisions.
Article 2 (Registration)
  1. Registration will be completed when the applicant agrees to the Policy, submits a registration request in accordance with the method specified by the Company, and receives approval notification from the Company.
  2. The Company may reject a registration request if it determines that any of the following reasons apply to the applicant and is under no obligation to disclose the reasons for its decision:
    1. The applicant provided false information in the registration process.
    2. The applicant has previously violated the Policy.
    3. The Company otherwise determines that registration is inappropriate.
Article 3 (Management of User ID and Password)
  1. Users are responsible for managing their own User ID and Password.
  2. Users are prohibited from transferring, lending, or sharing their User ID and Password with any third party under any circumstances. The Company will consider any login using a matching User ID and Password combination to be usage by the registered User.
  3. The Company shall bear no responsibility for any damage caused by the use of a User ID and password by a third party, except in cases of deliberate intent or gross negligence on the part of the Company.
Article 4 (Sale and Purchase Agreement)
  1. A Sale and Purchase Agreement for the Service is established when the User submits a purchase request to the Company, and the Company notifies the User of its acceptance of the request.
  2. The Company may terminate the Sale and Purchase Agreement without prior notice to the User if any of the following reasons apply to the User:
    1. if the User violates the Policy
    2. otherwise, if the Company determines that the trust relationship with the User has been undermined
  3. Due to the nature of digital content, the Sale and Purchase Agreement may not be terminated after downloading, streaming, or accessing, except in cases where the Company permits it.
Article 5 (Intellectual Property)
The copyright and other intellectual property rights to the product photographs and other content (hereinafter referred to as 'the Content') provided by the Service belong to the rightful owners, including the Company and the Content providers. Users are prohibited from copying, reproducing, reprinting, modifying, or otherwise using the Content without permission.
Article 6 (Prohibitions)
Users are prohibited from performing any of the following actions when using the Service:
  1. the actions violating laws or public order and morals
  2. the actions related to crimes
  3. the actions that infringe upon the copyrights, trademarks, and other intellectual property rights included in the Service
  4. the actions that destroy or disrupt the Company's server or network functionality
  5. the actions of commercially exploiting the information obtained through the Service.
  6. the actions that may disrupt the operation of the Service.
  7. the actions of attempting unauthorized access or actually accessing illegally
  8. the actions of collecting or storing personal information and other data about other users
  9. the actions of impersonating other users
  10. the actions that directly or indirectly provide benefits to anti-social forces in connection with the Service
  11. other actions that the Company deems inappropriate
Article 7 (Suspension of Providing the Service)
Users shall not engage in the following acts when using this service.
  1. The Company may suspend or terminate all or part of the Service without prior notice to Users if it determines that any of the following conditions apply:
    1. when maintenance or inspection or updates of the computer system related to the Service are being performed
    2. when providing the Service becomes difficult due to force majeure events such as earthquakes, lightning strikes, fires, power outages, or other natural disasters.
    3. when computers or communication lines are disrupted due to accidents
    4. otherwise, when the Company determines that providing the Service is difficult
  2. The Company shall bear no responsibility for any disadvantage or loss suffered by Users or any third party due to the suspension or interruption of the Service.
Article 8 (Limitation of Use and Account Cancellation)
  1. The Company may restrict all or part of a User's use of the Service or cancel a User's registration without prior notice:
    1. when Users violate any of the provisions of the Policy
    2. when it is found that there are false information in the registration information
    3. when the credit card registered by the User as a payment method is suspended
    4. when there is a failure to fulfill payment obligations, including fees
    5. when Users fail to respond to the Company’s contact within a certain period
    6. when Users have not used the Service for a certain period since the last use
    7. otherwise, when the Company determines that the use of the Service is inappropriate
  2. The Company shall bear no responsibility for any damages incurred by Users as a result of actions taken by the Company based on this provision.
Article 9 (Withdrawal)
Users may withdraw from the Service by following the prescribed withdrawal procedure.
Article 10 (Disclaimer of Warranties and Limitation of Liability)
  1. The Company does not guarantee that the Service is free from any actual or legal defects (including, but not limited to, defects, errors and bugs, infringements of rights, and issues related to safety, reliability, accuracy, completeness, effectiveness, suitability for a particular purpose, and security).
  2. The Company shall not be liable for any damages incurred by Users in connection with the Service. However, if the agreement between the Company and Users regarding the Service (including the Policy) constitutes a consumer contract as defined under the Consumer Contract Act, this limitation of liability shall not apply. Even in such cases, the Company shall not be liable for damages arising from the Company’s breach of duty or tort (except in cases of gross negligence) caused by special circumstances, including damages that the Company or Users could foresee or have foreseen.
  3. The Company shall bear no responsibility for any transactions, communications, disputes, or other issues arising between Users or between a User and any third party in relation to the Service.
Article 11 (Changes to the Service Content and Other Matters)
The Company may modify the content of the Service or suspend its provision without prior notice to Users, and the Company shall not be liable for any damages incurred by Users as a result.
Article 12 (Changes to the Policy)
The Company may modify the Policy at any time without prior notice to Users, if deemed necessary. Additionally, the User will be deemed to have agreed to the modified Policy by starting to use the Service after the changes.
Article 13 (Handling of Personal Information)
The Company will handle personal information obtained through their use of the Service in accordance with its Privacy Policy.
Article 14 (Notices and communications)
Notices and communications between the Company and Users shall be made in the manner prescribed by the Company. The Company will consider the currently registered contact information as valid unless a User submits a change request in accordance with the procedure specified by the Company, and will notify or communicate to that address. Such notices and communications will be deemed to have reached the User at the time of sending.
Article 15 (Prohibition of Transfer of Rights and Obligations)
Users may not transfer or pledge their status under the usage agreement or any rights or obligations based on the Policy to any third party without the prior written consent of the Company.
Article 16 (Governing Law and Jurisdiction)
  1. The governing law for the interpretation of the Policy shall be Japanese law. Furthermore, the United Nations Convention on Contracts for the International Sale of Goods shall not apply to the Service.
  2. In the event of a dispute regarding the Service, the court having jurisdiction over the location of the Company's headquarters shall have exclusive jurisdiction.
